TITLE REQUIREMENTS FOR FORECLOSED PROPERTIES:
- When Title Insurance is furnished:
- Original Owner of Mortgagees Title Policy of Title Insurance.
- A Title Insurance Policy insuring VA, subject to the owners right of redemption, expiration of the redemption period and recordation of the Sheriffs Deed.
- The following Original Documents: Certificate of Purchase, Assignment of Certificate of Purchase, Covenant of Warranty, and Assignment of Judgment.
- Completed Sheriffs Deed to VA (unsigned). Sedgwick County prepares the Sheriff’s deed so if the property is located in Sedgwick County please disregard this requirement.
- Order of Relief from Stay (bankruptcy), if applicable.
- If Title Insurance is not provided we require the following:
- Copy of Petition.
- Title Search secured when foreclosure action was begun.
- Title Search (update) through the date petition in foreclosure was filed.
- Journal Entry.
- Confirmed copy of personal service of summons, for all parties personally served.
- Confirmed copy of proof of publication of Notice of Suit, if such publication was necessary.
- Confirmed copy of Order of Sale.
- Confirmed copy of Sheriff's Return of Order of Sale.
- Newspaper clipping of any published notice of Sheriff's Sale and a showing of dates of such publication.
- Confirmed copy of order confirming sale.
- The following Original Documents: Certificate of Purchase, Assignment of Certificate of Purchase, Covenant of Warranty, and Assignment of Judgment.
- Completed Sheriff's Deed to VA (unsigned). Sedgwick County prepares the Sheriff’s deed so if the property is located in Sedgwick County please disregard this requirement.
- Order of Relief from Stay (bankruptcy), if applicable.
TITLE REQUIREMENTS FOR VOLUNTARY CONVEYANCES
- Loan Origination Title Policy
- Title Search showing clear title at time Deed in Lieu is considered.
- Supplemental Title Report showing Title in the name of the "Secretary of Veterans Affairs."
- Recorded Estoppel Affidavit.
- Deed from the obligor to the holder.
- Recorded Warranty Deed transferring title to the Secretary.
- Unrecorded, executed Release of Mortgage (VA will record after title is approved).
- Original Mortgage Note.
- Original or Certified Copy of Mortgage and all assignments.
ASSIGNMENT AND RELEASES ARE VALID ONLY WHEN SIGNED BY THE PRESIDENT, VICE PRESIDENT, SECRETARY, TREASURER OR CASHIER. NO ASSISTANTS.
