TITLE REQUIREMENTS FOR TERMINATED PROPERTIES
NEBRASKA


Title 38 CFR 36.4319 requires the holder of a VA guaranteed mortgage to send a copy of every procedural paper filed by or served upon the holder in any legal and/or foreclosure action to VA. These procedural papers are:

TITLE REQUIREMENTS:

  1. Title search/title commitment updated to the recording of Deeds. Name of insured to be Secretary of Veterans Affairs.
     
  2. Deed of Trust (DOT). [Note: We need the legal descriptions (LD) of each property. Therefore, if the LD is an exhibit to the DOT, please provide it as well.]
     
  3. Assignment of Deed of Trust. (Note: If the DOT was assigned more than once, we need all of the assignments.)
     
  4. Appointment/Assignment of Substitution/Successor Trustee, if applicable.
     
  5. Trustee's Deed.

  6. Corporation, Special, or General Warranty Deed to VA (as needed).
     

TITLE REQUIREMENTS FOR VOLUNTARY CONVEYANCES:

  1. Deed of Trust (DOT). [Note: We need the legal descriptions (LD) of each property. Therefore, if the LD is an exhibit to the DOT, please provide it as well.]
     
  2. Deed from borrower to the servicer.
     
  3. Estoppel affidavit (if not included in the deed).
     
  4. Satisfaction/release, if required by state law.
     
  5. Special Warranty Deed from holder to the Secretary.
     
  6. Title Policy issued in the name of the Secretary.
