Claim Package Requirements

Guaranteed Loans

1. Original VA Form 26-1874, Claim Under Loan Guaranty, or equivalent with authorized signature

2. A Certified Statement of Account. This should be a copy of the payment history or equivalent from the inception of the loan or at minimum from the date of default or the date of the first advance that is claimed. A key for reading the payment history must also be included.

3. Copy of paid receipts/invoices for items claimed in Itemized Advances and Itemized Liquidation Expenses

4. Bankruptcy docket report or equivalent (if applicable)

5. Copies of all deeds transferring title from the original veteran-obligor through the owner holding title at liquidation, with the social security number or taxpayer identification number of each obligor (if applicable)

6. Copy of foreclosure document showing amount bid at sale if property was not conveyed to VA (e.g. Trustee, Sheriff, or Foreclosure Deed)

 
Deed-in-lieu

1. Original VA Form 26-1874, Claim Under Loan Guaranty, or equivalent with authorized signature.

2. A Certified Statement of Account. This should be a copy of the payment history or equivalent from the inception of the loan or at minimum from the date of default or the date of the first advance that is claimed. A key for reading the payment history must also be included.

3. Copy of paid receipts/invoices for items claimed in Itemized Advances and Itemized Liquidation Expenses

4. Bankruptcy docket report or equivalent (if applicable)

5. Copies of all deeds transferring title from the original veteran-obligor through the owner holding title at liquidation, with the social security number or taxpayer identification number of each obligor (if applicable)

6. Copy of the Recorded Deed

7. SLMP Cases: VA Cost Analysis and signed Promissory Note (if applicable)

 
Compromise Sale (38 CFR 36.4342)

1. Recommend using the alternative Compromise Sale Short Form in lieu of
VA Form 26-1874.

2. A Certified Statement of Account. This should be a copy of the payment history or equivalent from the inception of the loan or at minimum from the date of default or the date of the first advance that is claimed. A key for reading the payment history must also be included.

3. Copy of paid receipts/invoices for items claimed in Itemized Advances and Itemized Liquidation Expenses

4. Bankruptcy docket report or equivalent (if applicable)

5. Copies of all deeds transferring title from the original veteran-obligor through the owner holding title at liquidation, with the social security number or taxpayer identification number of each obligor (if applicable)

6. Copy of HUD-1 Settlement Statement or similar closing statement with copy of proceeds check or wire transfer documentation

7. SLMP Cases: VA Cost Analysis, copy of the appraisal used to establish Property Value, copy of the signed Sales Contract, and signed Promissory Note (if applicable).

 
Refunding (38 CFR 36.4318)

1. Original VA Form 26-1874, Claim Under Loan Guaranty, or equivalent with authorized signature.

  • Claim must be submitted within 60 days of refund approval (settlement statement/cutoff date)

2. A Certified Statement of Account. This should be a copy of the payment history or equivalent from the inception of the loan or at minimum from the date of default or the date of the first advance that is claimed. A key for reading the payment history must also be included.

3. Copy of paid receipts/invoices for items claimed in Itemized Advances and Itemized Liquidation Expenses

4. Bankruptcy docket report or equivalent (if applicable).

5. Copies of all deeds transferring title from the original veteran-obligor through the owner holding title at liquidation, with the social security number or taxpayer identification number of each obligor (if applicable).

6. Documentation containing the legal description and the parcel or tax ID number and the insurance policy(s) endorsed to Department of Veterans Affairs c/o Countrywide Home Loans

7. Title Documents for Refunding. If not available at time of claim submission, they should be submitted as soon as possible following the claim. Claim payment will not be released until acceptable title is received.

 
Repurchase Claims (38 CFR 36.4600)

1. VA Form 26-8084,Claim for Repurchase of Loan

2. A Certified Statement of Account. This should be a copy of the payment history or equivalent from when the loan was purchased from VA or at minimum from the date of default or the date of the first advance that is claimed. A key for reading the payment history must also be included.

3. Copy of paid receipts/invoices for items claimed in Item 7, Advances.

4. Bankruptcy docket report or equivalent and an assignment of the Proof of Claim to VA (if applicable).

5. Copies of all deeds transferring title from the original obligor through the current owner, with the social security number or taxpayer identification number of each obligor (if applicable)

6. Documentation containing the legal description and parcel or tax ID number and insurance policy(s) endorsed to Department of Veterans Affairs c/o Countrywide Home Loans

7. VA Form 26-8543, Portfolio Loan- Statement of Settlement, or evidence provided by the Regional Loan Center to support the percent of PAR and principal balance, at the time the loan was purchased from VA.

8. Legal documents- Installment Contract/Mortgage and Mortgage Note/Deed of Trust and Deed of Trust Note (whatever is applicable to that state), and all assignments including assignment to VA.

9. Title evidence - Evidence of title (abstract, etc) received from VA when the loan was purchased.

 
Supplemental Claim
A supplemental claim may be filed for any items omitted from the original claim or paid for after it was submitted, or to contest a disallowance on the original claim. It is not necessary to use VA Form 26-1874, but a supplemental claim must be supported by the same documents required for the initial claim, such as receipts. A supplemental claim will be processed in the same manner as an initial claim.
