SUBJ: TITLE SUBMISSIONS (Supercedes Local Release 26-00-12, dated March 28, 2000)
This release will clerarly define what documentation is required for properties conveyed to the Department
of veterans Affairs (VA). This procedure is effective immediately for the seven state jurisdictional area of
the Manchester Regional Loan Center.
What Documentation is required?
- All documentation must include the VA loan number.
- The Notice of Election to Convey (VA Form 26-8903) must be received within 15 days of the
foreclosure sale or law date.
- Title Insurance Policies must be in the possession of the VA no later than 60 days from the foreclosure
sale or law date.
- A condominium requires that a 6D/Resale Certificate accompany the Title Policy.

What foreclosure documentation is required by state?
Connecticut Special Warranty Deed, Certificate of Foreclosure, and Title Insurance Policy
Massachusetts Special Warranty Deed, Foreclosure Deed, and Title Insurance Policy
Rhode Island Special Warranty Deed, Foreclosure Deed, and Title Insurance Policy
Maine Special Warranty Deed, Judgement of Foreclosure, and Title Insurance Policy
New Hampshire Foreclosure Deed and Title Insurance Policy
Vermont Judgement of Foreclosure, Special Warranty Deed, and Title Insurance Policy
New York Duplicate original or photocopy of executed and Acknowledged Deed to Secretary
of Veterans Affairs
Duplicate original or photocopy of executed and Acknowledged Referee's Deed, if
applicable
Affidavit of regularity and confirmed copy of Judgment of Foreclosure and Sale.
Owner's duplicate Certificate of Title (torrens title), if applicable
If available, the Abstract of Title & Copy of Survey
What is required for a Deed-In-Lieu?
- Original executed and recorded Deed to the Secretary of Veterans Affairs
- Estoppel affidavit
- Loan instruments
- An executed, unrecorded satisfaction of mortgage which will be recorded after acceptance of Title by
VA
- An order discontinuing the prior foreclosure action and canceling the lis pendens
- Foreclosure search that includes a bankruptcy and judgment search. A continuation letter to the date of
recording of the deed-in-lieu
- The Notice of Election to Convey (VA Form 26-8903) must be received within 15 days of the Deed
being recorded to VA
